Let me quote the relevant section

D. VACATION PAY
An employee shall be paid for vacation accrued through the last day on pay status upon:
1. resignation;
2. termination;
3. retirement;
4. indefinite layoff;

That’s from the Office of the President and the UC Human Resources and Benefits site. Your department can’t make itself a special case because the policy is very clear for the ENTIRE University of California.

If you want your time to be cashed out to you, then that time must be cashed out. Whether or not they can afford it. If they wanted it otherwise, they should have thought of that earlier and written a policy document for it.

Or, you could paraphrase a certain Mr. Folds and scream, “Give me my money, you bitch!”

As a soon-to-be-quitting occasionally-over-half-time UC employee, thank you for the reminder to cash in my vacation time, or call in sick a bunch, or whatever before my imminent resignation.

jenny- if she yells at me about my current plan, i will just be calling in sick those days and fuck them anyway. so i am all over the hanging out on top of you. i mean with you.

to everybody, you really didn’t reply fast enough as i sent the email at 4:30 saying, “hey i’m going to call in sick the last 4 days too, which will get me out of here on the 17th.” and then i ran away from the office. tomorrow i will have to face the music. i am terrified. i hate being this nervous to GO TO WORK. i hate these people for making me feel this way. and most of all i hate having worked there for 9 fucking months only to leave and probably never get a good reference out of them.

Sorry to here you came done with a deadly but harmless strain of the common cold, that happens to have no symptoms and last for 4 days.

email that the boss sent yesterday which i read last night:

“Sorry, Michele, this will not work because sick leave and vacation leave do not work the same way when you resign. Vacation leave is like income. You only take sick days with you if you go to another UC job. You don’t get paid for them upon resignation.

We need to talk about this tomorrow.”

how mad was i last night? pretty fucking mad.

but then driving to work i realized i was only so mad so i wouldn’t cry. which consequently made me cry. and now i’m at work. sitting and waiting for the boss to come in and “talk” at me.

Point them to the page I told you about. It’s absolutely true that vacation leave is like income. That’s why you get PAID for it when you leave the university. They can’t force you to take your leave.

If you want to work those last few days and then have them cash out those days, tell them to stuff it in their fucking ear.

The sick day stuff isn’t logically legal. But getting paid for those vacation days is.

it was an awfully good speech. but i think i am a wuss and will really just be working here till next friday when i will have my last day. maybe i’ll call in sick one day. this is soooo pathetic.

Hey how did it go? If you want to work to the end of the month and then get your vacation time you can. I don’t give a damn what they say about them paying for it and not the UC. You are technically a UC employee and are allowed to have your vacation time cashed out.

I hate that woman. You can always just call in sick for a couple of days. What are they going to do? Nothing. They can’t do anything you’re leaving anyways and they can’t prove your not sick.

I hope work didn’t suck too much today. Don’t worry it’ll be over next week and you’ll never have to talk to the woman again. It’s a beautiful thing. Believe me.

She needs a doctors note??? well dr. jade says you have just come down with a highly contagious bacteria (not virus, cuz then you can’t get rid of it…) and it will put you under for precisely 4 days. and it comes with rare, but not unheard of, symptoms of randomly losing consciousness and stapling objects (like skirts) to foreheads and stealing everyone’s left shoe.

My sister wanted to be a doctor at one time, so she can write you a note, right? So you can come chill with me and tell your heinous bitch of a boss to go screw herself? Right? =)
